This Acceptable Use Policy ("AUP") governs your use of the ixnodes Services operated by Innovatex Digital FZCO (IFZA, Dubai, license no. 49371). It is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. By using the Services, you and any users or end customers of your Services agree to comply with this AUP.
We may update this AUP at any time. Violations may result in throttling, suspension, or termination of the Services without refund, and may be reported to law enforcement or relevant authorities where appropriate.
1GENERAL PRINCIPLE
You may not use the Services for any purpose that is unlawful, harmful to our network or other customers, abusive to third parties, or that exposes ixnodes to legal liability or reputational harm. You are responsible for all activity originating from your Services, including the activity of your users and, for resellers, your end customers.
2PROHIBITED CONTENT
You may not use the Services to host, store, transmit, or distribute:
2.1Child sexual abuse material (CSAM) or any content that sexualizes minors. This is reported to authorities without notice and results in immediate termination.
2.2Content that infringes intellectual property rights, including pirated software, media, or counterfeit goods.
2.3Content that is defamatory, harassing, threatening, or that incites violence or hatred against individuals or groups.
2.4Content that violates the privacy of others, including unlawfully obtained personal or financial data.
2.5Content prohibited by applicable law in the UAE or in the jurisdiction from which it is served or accessed.
3PROHIBITED ACTIVITIES
You may not use the Services to:
3.1Send unsolicited bulk email (spam), operate spam relays, or engage in any email practice that violates anti-spam laws or harms our IP reputation. Bulk or transactional mail senders must maintain proper authentication (SPF, DKIM, DMARC), valid opt-in records, and acceptable complaint rates, and must obtain our prior approval.
3.2Distribute malware, viruses, ransomware, spyware, or other malicious code.
3.3Operate command-and-control infrastructure, botnets, or phishing or fraudulent websites.
3.4Launch or participate in denial-of-service (DoS/DDoS) attacks, or originate any attack traffic.
3.5Conduct unauthorized port scanning, vulnerability scanning, penetration testing, or intrusion attempts against systems you do not own or lack written authorization to test.
3.6Engage in IP address spoofing, ARP/MAC spoofing, route hijacking, or any forgery of network identifiers or headers.
3.7Circumvent or attempt to circumvent any usage limits, billing controls, security measures, or resource allocations.
3.8Engage in fraud, including carding, payment fraud, or use of stolen payment instruments.
3.9Mine cryptocurrency except where expressly permitted and on plans designated for such use. Cryptocurrency mining on standard shared-infrastructure plans is prohibited as it constitutes abuse of shared resources (see also the Fair Usage Policy).
3.10Resell or sublicense the Services except under an approved ixnodes reseller arrangement.
4NETWORK AND RESOURCE INTEGRITY
4.1You may not take any action that degrades, disrupts, or threatens the stability, performance, or security of the ixnodes network or that of any other provider.
4.2You may not consume resources in a manner inconsistent with the purchased plan or the Fair Usage Policy.
4.3You may not interfere with other customers' use of the Services or attempt to access accounts, data, or systems that do not belong to you.
5EMAIL AND MESSAGING
5.1Mail-sending workloads are subject to additional controls, including rate limits, and require accurate, traceable sender identity.
5.2We operate abuse monitoring and may rate-limit or block outbound traffic (including SMTP) that triggers abuse signals, complaints, or blocklisting.
5.3Repeated or severe email abuse results in suspension or termination.
6ABUSE REPORTING AND ENFORCEMENT
6.1Abuse reports may be sent to abuse@ixnodes.com. We operate automated and manual abuse monitoring across our network.
6.2On receipt of a credible report or detection of abuse, we may, at our sole discretion and depending on severity: request remediation within a stated timeframe; throttle or null-route affected traffic; suspend the affected Service; or terminate the Account.
6.3For severe or ongoing abuse (e.g., active attack traffic, CSAM, phishing), we may act immediately and without prior notice to protect our network and third parties.
6.4We cooperate with legitimate requests from law enforcement, CERTs, and abuse clearinghouses (including Shadowserver) consistent with applicable law and our Privacy Policy.
6.5You agree to respond promptly to abuse notices. Failure to remediate is a material breach.
7RESELLER RESPONSIBILITY
If you resell the Services, you must flow down this AUP to your end customers, monitor their use, respond to abuse notices relating to their activity, and remain fully responsible to us for their compliance.
8CONSEQUENCES OF VIOLATION
Violations may result in any combination of: warning, mandatory remediation, traffic filtering, throttling, suspension, or termination. Termination for AUP violation does not entitle you to any refund. You remain liable for any damages, costs, or third-party claims arising from your violation.
